Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AgentShell (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

AgentShell is an iOS SSH terminal client application that allows users to:

• Connect to remote servers via SSH
• Manage SSH connection profiles
• Generate and store SSH keys
• Interact with AI coding assistants through terminal sessions

3. User Responsibilities

You are responsible for:

• Ensuring you have authorization to access any servers you connect to
• Maintaining the security and confidentiality of your credentials
• Complying with all applicable laws and regulations
• Any actions taken through connections established using the App
• Ensuring your use of the App complies with your organization's policies

4. Prohibited Uses

You agree not to use the App to:

• Access systems without proper authorization
• Engage in any illegal activities
• Violate the security or integrity of any computer network or system
• Transmit malware, viruses, or other harmful code
• Interfere with or disrupt the operation of any systems or networks
• Violate the rights of any third party

5. Intellectual Property

The App, including its design, features, and code, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of the App or its content.

6. Third-Party Services

The App facilitates connections to third-party servers and services. Your use of such services is subject to their respective terms and policies. We are not responsible for:

• The availability or reliability of third-party services
• The content or security of third-party servers
• Any damages resulting from your use of third-party services

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS

We do not warrant that the App will be uninterrupted, secure, or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless AgentShell and its developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms. Your continued use of the App after changes constitutes acceptance of the new Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Apple App Store Terms

If you download the App from the Apple App Store, you also agree to:

• Apple's Licensed Application End User License Agreement (available at apple.com/legal)
• These Terms supplement (do not replace) Apple's standard EULA
• Apple has no obligation to provide any maintenance or support services for the App
• Apple is not responsible for addressing any claims relating to the App

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
